RICHMOND, VA 1:00PM –
  Wednesday January 13th , 2010 – Delegate Elect Robin Abbott was sworn in
on this first day of the 2010 General Assembly Session as the Delegate from the 93rd District
representing Newport News and James City County with support from family and friends. Abbott took the
oath of office along with twenty other newly elected Members for a near House record.
 
Robin Abbott received her committee assignments and will serve on the House Finance
Committee and the House Science and Technology Committee.

DELEGATE ROBIN A. ABBOTT ARGUES ON BEHALF OF THE PEOPLE OF THE COMMONWEALTH OF VIRGINIA IN OPPOSITION TO LEGISLATION AGAINST THE CONSUMER

RICHMOND, VA 12:30PM –
  Wednesday January 27th, 2010 – Delegate Robin Abbott today on the floor of the House Chamber session argued in opposition to House Bill 392; vehicles damaged by water, which would raise the existing threshold for reporting water damage during the buying and selling of an automobile from $1000 to $5000 in Virginia. Delegate Abbott, backed in support by other House Democrats and a litany of qualified and accredited consumer advocacy organizations, posed direct questions to the real-life ramifications of such a bill to citizens of the Commonwealth.
 
Delegate Abbott believes that the adoption of HB392 will unequivocally “open up the floodgates for every water damaged vehicle in the United States to be dumped into Virginia and sold to unsuspecting citizens,” water damaged vehicles to be unfairly left in the hands of Virginians with no prior notice in the form of a statement attached to the vehicles title for their knowledge to the condition of the vehicle they are about to purchase. There have been hundreds of thousands of water damaged vehicles in the country as a result of mass tragic events such as multiple and devastating hurricanes, nor-easters, and storms, these vehicles are still showing up for sale around the country. We have an obligation to provide the same protections as the rest of the country to anyone who buys a vehicle in Virginia, the right to know what the actual condition of a car is before buying it, regardless of price.
 
“This law is unique to Virginia. No other state in the country provides a “safe-harbor” for water damage to a vehicle. Virtually every state has a fraud statute that says the seller cannot conceal a “material fact.” Certainly water damage that affects the use, value or safety is a material fact, Giving insurers and dealers a $5000 safe harbor for non-disclosure encourages fraud that will put people’s lives in danger.”
